O mensu entre a legalidade e ilegalidade: o 'Legal' e 'Ilegal' a partir das relações socioculturais

Abstract

Longe de descartar as concepções de ―legal‖ e ―ilegal‖ desenvolvidas por sociólogos e antropólogos, principalmente os desenvolvidos em regiões de fronteira, este trabalho pretende, ao final, propor (pelo menos a nível das relações sociais desempenhadas nas obrages na fronteira paranaense com o Paraguai e Argentina), uma concepção de legalidade e ilegalidade a partir das relações sociais, culturais e históricas desempenhadas entre as vítimas da Guerra do Paraguai, que tornaram-se mensus na extração de erva-mate e madeira no Oeste paranaense, os capitalistas obrageiros, e o Estado. Ou seja, pensar formas de ilegalidade e legalidade para relações socioculturais. Para isso foi utilizado como metodologia uma análise bibliográfica e comparativa de fatos históricos e estudos de caso

Far from dismissing the conceptions of "legal" and "illegal" developed by sociologists and anthropologists, especially those developed in borderlands zones, this work intends at the end to propose (at least at the level of social relations carried out in the obrages at the boundary between Brazil, Paraguay and Argentina), a conception of legality and illegality from the social, cultural, and historical relations played out among the victims of the Paraguayan War, who became mensus in the extraction of erva-mate and wood in the West of Paraná, the Capitalist laborers, and the State. That is, to think of forms of illegality and legality for social and cultural relations. For this, a bibliographical and comparative analysis of historical facts and case studies was used as methodology
