Políticas para refugiados na União Europeia no século XXI: O Sistema Europeu Comum de Asilo – SECA a partir da realidade italiana

A última década foi marcada pela emergência da crise migratória que atinge o continente europeu. Um fluxo grande de pessoas em busca de proteção internacional se direcionou rumo a União Europeia, deixando países do norte da África e Oriente Médio e tomado como porta de entrada países do sul do continente, como a Itália, por razões geográficas. O Sistema Dublin determina que o país responsável pelo processamento do pedido de refúgio é aquele cujo migrantes utilizaram para adentrar a UE. Assim, processo de concessão de asilo é submetido ao Sistema Europeu Comum de Asilo – SECA– . O aumento do número de requerimento de proteção internacional na Itália acarreta no não cumprimento das normativas comuns a União ocasionado o surgimento do fenômeno denominado Asylum Shopping. Objetivou-se a partir desse trabalho analisar, através de revisão bibliográfica e um breve estudo de caso, identificar imprecisões sistêmicas que contribuem para o não eficiência dessas normativa na Itália. Assim, constatou-se que a lentidão do sistema italiano, assim como a influência do discurso conservador de Matteo Salvini, atrelados à sobrecarga dos órgãos responsáveis pelo processo de análise de concessão de refúgio e a falta de um trabalho de integração cultural caracterizam um país desorientado perante ao papel do Estado frente essa crise. The last decade has been marked by the emergence of the migratory crisis in the European
continent. A large flow of people seeking international protection headed towards the European
Union, leaving countries in the of North Africa and the Middle East, taking as a gateway
southern countries such as Italy due to geographical reasons. The Dublin System determines
that the country responsible for processing the refuge application is the country which the
migrants used to enter the EU. Thus, the asylum procedure is submitted to the Common
European Asylum System – CEAS –. The increasing number of international protection
requests in Italy results in the non-compliance of the Union’s common rules, coming out in the
emergence of the phenomenon called Asylum Shopping. The objective of this work was to
analyze, through bibliographic review and a brief case study, and identify systemic inaccuracies
that contribute to the non-efficiency of these regulations in Italy. Thus, it was observed that the
slowness of the Italian system, as well as the influence of Matteo Salvini's conservative
discourse, linked to the increased workload on entities responsible for the process of granting
asylum and the lack of a cultural integration work characterize a disoriented country regarding
to the role of the State when facing this crisis
